About the Speaker

Jake Aryeh Marcus, J.D., is the nation's foremost expert on breastfeeding law. She is a lawyer whose private practice focuses on parenting and civil rights (particularly breastfeeding, mothering, and domestic violence),  the business issues of non-physician health care practitioners, and the rights of special needs students. She was Politics Editor at Mothering magazine until it ceased publication. Marcus is the author of "Lactation and the Law," a comprehensive article on U.S. public breastfeeding law, "Pumping 9 to 5," an article on workplace pumping law which was a finalist for a MAGGIE Award and, most recently, "Lactation and the Law Revisited." Her over 20 years of practice as an attorney includes serving as litigation coordinator for the Women Against Abuse Legal Center in Philadelphia, and on Planned Parenthood's trial team in its challenge to the constitutionality of the Pennsylvania Abortion Control Act. She was a member of the Board of Directors of the AIDS Law Project of Pennsylvania and was a member of the Legal Advisory Council to La Leche League International. Her writing has appeared in Mothering, Life Learning, LEAVEN, The Philadelphia Lawyer, Vegetarian Baby and Child, and on ePregnancy.com and VegFamily.com. Is breastfeeding a civil right under U.S. law? What does that mean? Is your state law as strong as you think it is? An examination of differences in local laws, protections under federal laws, non-legal options available to breastfeeding women, and your state's particular breastfeeding law. This session focuses on breastfeeding in public accommodations, which include stores and restaurants.

Supporting Breastfeeding Women in the Legal System

Breastfeeding women find themselves in need of assistance in a wide variety of legal contexts. This session reviews the options available to lactating women in custody disputes, as criminal defendants, as witnesses, when called for jury duty, and as immigration detainees.

Breastfeeding 2.0: Law and Ethics in Providing Breastfeeding Support Using the Internet

60 - 120 minutes

Social Media creates more opportunity to provide breastfeeding support to a wider audience of women. However, improper use of websites, Facebook, Twitter and other Internet fora also endanger privacy, risk violating ethical rules and require different safeguards. This session will explore best practices in professional Internet conduct.

Legislation and Sausage: Creating Breastfeeding Law in Your State

60 - 120 minutes

Participants will learn the elements of effective state breastfeeding legislation as well as the process by which it is created. Attendees will engage in legislative drafting as well as debate, divided into small groups that include representatives from breastfeeding coalitions and chambers of commerce. Through education, negotiation and compromise, attendees will live the legislative process.

World Peace Begins At Home: Domestic Violence and the Breastfeeding Mother

30 - 120 minutes
CERP

The first incident of violence in a relationship often occurs during pregnancy or shortly after the birth of a child. Volunteers and health care providers often feel helpless when faced with mothers in violent relationships. In this session, participants will learn to recognize the signs of domestic violence, how to locate resources for mothers and how to assist in maintaining the breastfeeding dyad without endangering mother or child. Participants will also learn to identify their legal and ethical obligations under their respective professional scopes of practice.
